Most parents do everything they can to protect their children. They use car seats, cut their child’s food into small pieces so they won’t choke and attend to them closely while bathing. It is fair to say they would never knowingly expose them to something that could lead to a serious injury. Unfortunately, dangerous items are not always obvious to parents. This is illustrated in the recent deaths of toddlers due to Ikea dressers falling upon them.
So far, two toddlers have died after the dresser model called Malm, fell upon them. Following the second death, the Consumer Product Safety Commissions and Ikea, issued what they called a “repair program.” Similar to a recall, the company offered to send restraint kits to the owners of 27 million dressers.
The parents of one of the toddlers who was killed recently filed a wrongful death lawsuit against the retailer. Among other things claim asserts Ikea designed and continued to sell the dresser despite being aware it was unstable. The lawsuit was filed in Philadelphia Common Pleas Court.
In the lawsuit, among other things, the family seeks unspecified compensation and punitive damages for:
- Medical expenses
- Funeral expenses
- The pain and suffering of the child
- The emotional distress of the family
